Why most law firm AI projects fail in the first 90 days.
Gartner says 40% of agentic AI initiatives will fail by 2027. Inside law firms, the failure mode is more specific than that — and disappointingly predictable.
Every law firm of meaningful size is now running, or about to run, some kind of AI initiative. Intake bots. Drafting copilots. Document review tools. Marketing content engines. The pitch decks all promise the same thing: 40% time savings, 75% faster review, 88% lower discovery costs. The numbers are even mostly real. So why are so many of these projects quietly shelved by the time the firm hits its second renewal?
We've been on the inside of dozens of these projects, sometimes as the marketing partner, sometimes as the operations lead, occasionally as the people called in to clean up after a previous vendor. The reasons firms fail with AI aren't usually about the AI. They're about everything around the AI — and they show up in roughly the same four ways every time.
1. The firm bought a tool when it needed a system.
The most common pattern: a partner sees a demo at a conference, signs a contract, and the tool gets bolted onto the firm's existing workflow. Six weeks in, intake is using the AI bot for some inquiries but not others, the receptionist is still doing it the old way for after-hours calls, and the CRM has two parallel sets of records that no one quite trusts.
AI doesn't replace operations. It rides on top of operations. If the underlying intake process is broken, AI doesn't fix it — it just adds a new failure surface to an already-broken process. The right sequence is almost always: document the process, then automate the parts that warrant it, then bring AI to the parts that benefit from it. Most firms try to skip the first two steps and wonder why the third one underperforms.
2. There's no governance layer.
In legal, this isn't optional. Confidentiality, privilege, conflict checks, citation accuracy, work-product doctrine, ethics rules — none of these get a pass because the workflow now involves an AI agent. And yet firms routinely deploy AI tools without ever defining who reviews what, what gets escalated, what gets logged, and how the firm would respond if a state bar showed up asking how a piece of work was produced.
Gartner's 40% projection isn't pulled out of thin air. Lack of governance is the single most-cited reason agentic AI projects fail across industries, and legal is more exposed than most. The firms that get this right architect for governance from day one — auditable decisions, mandatory human checkpoints, citation verification, escalation triggers. The firms that don't end up with an AI tool that looks great in the demo and that nobody trusts to send a real client email.
AI in legal isn't a productivity layer. It's a workflow layer. And workflow layers in law firms have to be defensible.
3. The marketing side and the ops side are running separate AI projects.

The case management team buys an AI document review tool. None of these systems talk to each other. None of them share a definition of what a "qualified lead" is. None of them roll up to a single dashboard the managing partner can use to actually run the firm.

The handoff between systems — between demand and delivery — is where the value lives, and where the AI mostly hasn't been pointed.
You don't need more AI tools. You need one operating system with AI inside it, and a clear seam where marketing data flows into operations data and back into attribution.
4. Nobody owns the project six weeks in.
The first 90 days of any AI project follow a curve. Weeks 1–3: excited. Weeks 4–6: things mostly work. Weeks 7–9: the small failures start to compound. Weeks 10–12: someone has to decide whether to fight through, escalate, or quietly shelve the tool. By week 12, if there isn't a named owner with the authority to fix what's broken, the project dies — usually without anyone formally killing it. It just slowly loses traction until people stop using it.
This is the boring answer that nobody wants to hear: AI projects fail in law firms not because the technology underperforms, but because the organization underperforms around the technology. There's no leader, no cadence, no scoreboard, no one whose job it is to push through the inevitable week-six trough. The fractional COO model exists for a specific reason — somebody has to be the project's immune system during the months that matter.

AI fails in law firms when it's bought as a product instead of installed as a system, deployed without governance, run in parallel silos, and managed without an owner. Fix any of those four and the technology will probably hold up. Fix all four and the productivity numbers in the demos start being roughly real for your firm too.
